On 4.7.2023, the Commission published a proposal for a Regulation on the adoption of regulation supplementing the EU General data protection Regulation. The proposal would improve cooperation between the national data protection authorities of the Member States in cross-border cases by harmonising certain administrative procedures. The Regulation (EU) 2025/2518 has been published in the Official Journal and will apply from 2.4.2027.

Goals and results

The aim of the legislative project is to streamline cooperation between the national data protection authorities of the Member States in cross-border cases. To this end, the Commission proposes regulation to harmonise some administrative procedures applied by national data protection authorities in cross-border cases. The proposed amendments would improve the functioning of the cooperation and dispute resolution mechanisms of the General data protection Regulation.

Starting points

The legislative iniative is based on a letter from the European Data Protection Board (EDPB) to the Commission in autumn 2022. In the letter, the EDPB has compiled elements related to national administrative procedures that should be harmonised. According to the EDPB, harmonisation of national procedures and practices would improve the implementation of the GDPR and cooperation between data protection authorities. The summary was submitted to the European Commission for consideration. The summary deals, inter alia, with the status and rights of the parties to administrative proceedings, the time limits for the proceedings, the admissibility or rejection of complaints, the investigative powers of the data protection authorities and the cooperation procedure.

The Commission's work programme for 2023 includes the following entry for the project: “To improve the cooperation between national data protection authorities in enforcing the General Data Protection Regulation, the Commission will propose to harmonise some national procedural aspects of their work.” (See link to the work programme below)
